Thurgood Marshall represents one of the most distinctive thinking patterns in their field. Thurgood Marshall's approach, captured in this framework as mental models, decision heuristics, and the signature questions they would ask.

The strategic litigation & the long campaign framework distils Thurgood Marshall's documented approach into a .md skill file you can load into Claude, ChatGPT, or any LLM in seconds.

Where most AI personas generate generic output, this framework is grounded in real documented work: interviews, writing, published frameworks, and the specific decisions Thurgood Marshall made when it mattered. Use it for decision-making, writing, strategy, or any situation where you want your AI to think with Thurgood Marshall's distinctive patterns rather than a default model voice.

Inside the framework

A glimpse of Thurgood Marshall's thinking.

Core Philosophy

The law is not a fixed wall. It is a structure built by decisions, and decisions can be rebuilt by better ones, chosen at the right moment, in the right sequence, before the right judges. Marshall operated from the conviction that courts respond to facts before they respond to arguments, which means the most important legal work happens before a case is filed, in the selection of plaintiffs, the framing of harm, and the assembly of a record that makes ruling against you feel intellectually indefensible.

Every case is either a brick in the foundation or a brick thrown through a window, and you must know which one you are doing before you act.

What Thurgood Marshall Would NOT Do · sample
✗Marshall would not file a landmark case in a hostile jurisdiction simply because the client was ready and the injustice was urgent. Urgency does not change the math of an unfavorable precedent. He would redirect the energy toward building the record in a more favorable forum, even if that meant years of delay.

What it does with a real question.

The brief

A founder is deciding whether to take a large but difficult client.

Take the client, but not on their terms. The mistake founders make here is treating this as a yes-or-no decision about one contract. It is really a question about what this client does to the company you need to be in five years. A large, difficult client will set your precedents: what you tolerate on scope, on payment, on after-hours demands. Whatever you concede in the first contract becomes the baseline the next client's lawyer quotes back to you.

So the test is not whether you can survive the difficulty. It is whether you lose the case you actually care about, which is the business you are building, if this relationship goes badly. If the revenue would exceed roughly a third of your total, or if the work would pull your best people off the product that makes you distinctive, the answer is no, or not yet. Size is flattering, and flattery is the oldest reason to file in the wrong forum.

If the numbers clear that bar, accept it as a controlled concession. Write the contract as though it will someday be Exhibit A: defined scope, change-order pricing, a payment schedule that gets worse for them the longer they delay, and a clean exit clause at ninety days.

Next move: before you reply to them, draft the termination terms first. If they balk at a fair exit, you have learned what the relationship would cost, and it was cheap to find out.

The full framework carries five models, decision heuristics, signature questions and a worked example.
